GENERAL TERMS AND CONDITIONS

Connecting to our website, activating a BACKtoOWNER label or keytag and/or doing business with BACKtoOWNER implies acceptance by the Owner of the following general terms and conditions.

Definitions :

• BACKtoOWNER:
  a service supplied by FRESH sprl, the purpose of which is to supply a service which enables Owners to effectively and durably "mark" their personal property or valuables, and thus greatly increases their chances of retrieving them in case of loss. After affixing a BACKtoOWNER label or keytag to an object, anyone who finds that object can contact us immediately to return it and receive a reward from us!
  
  
• THE OWNER :
  the Owner is the individual who activates a BACKtoOWNER label or keytag and supplies his/her personal information.
  

Privacy :
BACKtoOWNER acknowledges the applicability of the Belgian Law of December 8, 1992 related to the processing of personal data to all processing and collecting of information performed in Belgium via the BACKtoOWNER website and included in our files. For further information please consult our Confidentiality and Privacy Policy.

Use and specific characteristics of the service :
BACKtoOWNER labels or keytags have a limited lifetime. The validity of your label or keytag is specified at the time of activation (registration of the label number and your personal information). Once expired, the label or keytag becomes obsolete but can be reactivated on our website. The user is notified by e-mail (and e-mail only) one week prior to expiration of the service, and remains free to reactivate or not the label (no obligation). If the Owner has no e-mail address, BACKtoOWNER will not be able to notify him/her.

BACKtoOWNER supplies a global service via its website. The BACKtoOWNER telephone service is limited to a specific territory. If the object is found outside this territory, the BACKtoOWNER service may be only available via its website. In other words, although protection via the website is global, the telephone service (call center) may be limited geographically.

The Owner must keep his/her information up to date. BACKtoOWNER shall not be held liable should we not be able to contact the Owner using the data available to BACKtoOWNER.

BACKtoOWNER shall use the data supplied by the Owner as well as the appropriate means of communication to notify the Owner that the object has been found. However, BACKtoOWNER does not guarantee that messages sent via these means of communication will be received.

BACKtoOWNER supplies high quality labels and keytags. However, it is the Owner's responsibility to ensure regularly that the label or keytag is properly affixed to the object. BACKtoOWNER shall not be held liable should a label or keytag come off or become unusable prior to the expiration date of the protection.

BACKtoOWNER and any person finding lost property shall not be held liable should the lost property be returned to its Owner in a damaged condition or lost during shipping.

In certain specific cases, BACKtoOWNER shall use external service companies (post office, courier companies, private couriers, etc.) to return the object to its Owner. BACKtoOWNER shall not be held liable for the performance of these external suppliers.

BACKtoOWNER shall do its utmost to ensure that the property is returned as soon as possible to its Owner, but does not guarantee any specific time.

Any charges related to the return of the found property shall be paid by the Owner (unless specified otherwise at the time of activation of the service), and in no circumstances by the person who has found the property. The Owner shall always be notified before the costs are incurred, and the Owner's prior consent will be required.

The BACKtoOWNER service merely assists the return of lost property to its owner, and does not in any way guarantee that such property will be found and/or returned to its Owner if lost.

BACKtoOWNER shall not be liable in case of error or inaccuracy in the advertising or messages published by sponsors or marketing partners.

BACKtoOWNER shall not be held liable for misuse of the website.

Computer security :
Despite all the precautions taken by BACKtoOWNER, BACKtoOWNER cannot guarantee that its security system will not be violated, and therefore cannot be held liable for the consequences of such attacks. Also, BACKtoOWNER shall not be held liable should the contents of the website be attacked by or affected by a computer virus.

Changes to and cessation of the Service :
BACKtoOWNER hereby notifies the Owner that it reserves the right to make changes to or terminate the service, no compensation whatsoever being due to the Owner.

By using the service, the Owner accepts any eventual changes made to the service.

BACKtoOWNER shall only be held liable in case of serious misconduct on its part with respect to its role as defined by these terms and conditions.

BACKtoOWNER shall not be liable should it not be possible to perform all or part of its service for reasons beyond its control.

BACKtoOWNER cannot guarantee that (I) the service offered fulfils the Owner's specific expectations or requirements, (II) the service will be uninterrupted, secure, or free of error.

BACKtoOWNER hereby notifies the Owner that the BACKtoOWNER website may contain links or hyperlinks to other websites ("linked websites"). The Owner agrees that BACKtoOWNER shall not in any way be liable for the contents of a linked website or for any product or service referred to by the linked website. Linked websites are managed by outside parties with no connection to BACKtoOWNER .

Owner behavior :
The Owner shall in particular :
- Refrain from using the service for illegal purposes.
- Refrain from disturbing or interrupting the network connected to the service or third party servers.
- Comply with all regulations, codes of conduct and procedures applicable to the Internet.
- Refrain from disturbing the use and operation of the service or of any similar service.

Expiry or termination :
BACKtoOWNER may terminate the service without prior notification and without any compensation being due.
The Owner may, at any time and without supplying any reason, deactivate the BACKtoOWNER service by clicking on the appropriate button on the website.

Autonomy
Should one of these terms and conditions be declared void or inapplicable, the other terms and conditions shall remain in full force.

Full agreement
These terms and conditions comprise all agreements made between the parties concerning their subject and the BACKtoOWNER service.

Applicable legislation and jurisdiction
This charter is governed, interpreted and implemented as per Belgian law; the Brussels law courts shall have sole jurisdiction in case of any dispute arising from the interpretation or application of these terms and conditions.
The BACKtoOWNER concept is the property of FRESH sprl.
The BACKtoOWNER concept has been registered with the United States Patent and Trademark Office (patent pending: 60/407,647). BACKtoOWNER is a registered trademark and is the property of FRESH sprl.
